Please read these terms and conditions carefully before using Our Service.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

Country refers to: United Kingdom

Organisation (referred to as either “the Organisation”, “We”, “Us” or “Our” in this Agreement) refers to Bournemouth Folk Club, Poole, Dorset.

Device means any device that can access the Service such as a computer, a mobile phone or a digital tablet.

Tickets refer to the tickets for performances offered for sale on the Service.

Orders mean a request by You to purchase tickets from Us.

Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Organisation regarding the use of the Service.

Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

Website refers to Bournemouth Folk Club, accessible from https://bfcpresents.co.uk/

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Placing Orders for Tickets

By placing an Order for Tickets, You warrant that You are legally capable of entering into binding contracts.

Your Information

If You wish to place an Order for Tickets, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.

You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.

By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.

Tickets – terms and conditions of sale

When you confirm your purchase, you are accepting that these terms and conditions form the basis of a contract between Bournemouth Folk Club and yourself.

Tickets are valid for the date and time stated. Please check your tickets on receipt as mistakes cannot always be rectified later.

We operate a strict policy of no refunds or exchanges for tickets bought either online or in our venues unless a performance or session is rescheduled or cancelled.

In the event of a cancelled performance or session, Bournemouth Folk Club will refund the ticket price but will not be liable for any booking fees or any additional expenses, for example travel or accommodation.

Tickets and items purchased where a discount or benefit has been claimed without entitlement are in breach of our terms and conditions of sale, will be declared void and are not valid for entry.

We reserve the right to change prices, advertised arrangements and seating allocations at any time.

Tickets must not be sold or resold and are non-transferable. Any re-sale or exchange of a ticket automatically renders it void.

Bournemouth Folk Club or any permitted third parties may carry out general filming, live streaming, photography and sound recording in or about the venue and your consent for this filming may be requested. Please advise venue staff if you do not wish to participate.

Failure to adhere to our Terms and Conditions of Sale may result in tickets not being valid for entry.

Bournemouth Folk Club reserves the right to refuse entry or terminate a visit.

Gift vouchers – terms and conditions of sale

Gift vouchers are valid for 12 months from the date of purchase and may be redeemed against concert tickets on the Bournemouth Folk Club website.

Gift vouchers may be used in full or partial payment.

Where the cart value exceeds the gift voucher amount, the full value of the gift voucher will be used and any remaining balance must be paid by credit card.

Where the gift voucher amount exceeds the cart value any remaining balance on the gift voucher will remain available to be used against a future purchase. The balance remaining on a gift voucher may be checked by entering the gift voucher code in the box on the Gift Voucher page on the website.

Gift vouchers are not refundable.

COVID-19

Track and trace

Should government guidance require, we will collect your personal data (name, address and contact number as a minimum) to use for track and trace purposes in the event of a reported case of coronavirus. We will collect this through your ticket purchase. This data will be retained for 21 days in accordance with government requirements. Your data will not be shared with any additional third parties.

Rescheduled Events

If you have tickets booked with us, and are unable to make the rescheduled event date please email us on info@bournemouthfolkclub.com. All tickets will be automatically carried over to the new date.

Cancelled Events

Unfortunately, sometimes we are unable to reschedule events affected by Covid-19. If you are a ticket holder to a cancelled event, we will get in touch with you using the contact details you supplied when you made your booking. You can then choose if you would like to:

Receive a refund of the face value of the ticket, in line with our standard Terms & Conditions.

Donate the the face value of your ticket to Bournemouth Folk Club. All donations will be shared between the affected artist and Bournemouth Folk Club. Every donation helps to secure our future as we navigate these challenging times. If you would like to do this, please let us know on info@bournemouthfolkclub.com.

Convert the face value of your ticket to credit for use against a future ticket purchase.

Ticket holders affected by Covid-19

Should you receive a positive PCR test result for Covid-19 or are instructed by Track and Trace to self-isolate as a result of close contact with a positive Covid-19 case please do not attend. Please email us on info@bournemouthfolkclub.com with a copy of your Track and Trace notification and to discuss your options, which are the same as for Cancelled Events.

Prices Policy

The Organisation reserves the right to revise its prices at any time prior to accepting an Order.

The prices quoted may be revised by the Organisation subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action, or any other matter beyond the control of the Organisation. In that event, You will have the right to cancel Your Order.

Payments

All Tickets purchased are subject to a one-time payment. Payment can be made through various payment methods we have available, such as Visa or MasterCard cards or online payment methods (PayPal, for example).

Payment cards (credit cards or debit cards) are subject to validation checks and authorisation by Your card issuer. If we do not receive the required authorisation, We will not be liable for any delay or non-delivery of Your Order.

Links to Other Websites

Our website may contain links to third-party web sites or services that are not owned or controlled by the Organisation.

The Organisation has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Organisation shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Organisation and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service.

Governing Law

The laws of the England and Wales shall govern these Terms.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our website. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time.
